  • With due respect to the man and his notable work, Mr. La Russa’s lawsuit was an unnecessary waste of judicial resources bordering on frivolous. Twitter’s Terms of Service are fair and we believe will be upheld in a court that will ultimately dismiss Mr. La Russa’s lawsuit.
  • Twitter co-founder Biz Stone • In response to a lawsuit filed by St. Louis Cardinals manager Tony La Russa about a faked account which the site already removed. They will not settle and will fight the case in court if necessary. Stone did take the opportunity, however, to tell people about Twitter’s new verified account program, which will only take a few people at first but over time will expand and include more notable users and, down the road, businesses.   • There’s no more to Holden Caulfield. Read the book again. It’s all there. Holden Caulfield is only a frozen moment in time.
  • A 1980 quote from J.D. Salinger • Referred to in his lawsuit against the producers of “60 Years Later: Coming Through the Rye,” a book that brings Holden Caulfield into the present day. The producers of the book, which is authored by “J.D. California,” also make lots and lots of joke books. Salinger, based in New Hampshire, has successfully avoided the spotlight since last publishing in 1965. May we just point out – gay marriage legal in NH on the same day NH’s most famous recluse returns to the public eye? Clearly not a coincidence. • source

Tech: Apple clonemakers alternatingly rise and fall

  • Apple has a new unauthorized clone manufacturer to deal with. Quo Computer launches this week with a L.A.-based retail outlet. They plan to prove their worth to Apple by focusing on quality.
  • Good thing they showed up when they did, because fellow clone maker Psystar just filed for Chapter 11 bankruptcy. They’ll still sell Hackintoishes, but their lawsuit against Apple was put on hold.

Biz: This is why the Associated Press should not fight a copyright war

  • The AP claims copyright ownership in, and makes commercial use of, many photographs that consist almost entirely of copyrighted artwork of Fairey and other artists without permission.
  • Excerpt from “Fairey Answer to AP Counterclaims” • This court document from Shepard Fairey (the guy behind the iconic Obama poster and Obey Giant), among other things, attacks the Associated Press for a double standard. The AP is asking Fairey for compensation for using one of their photos to create his Obama artwork. Fairey then sued to have a court say his art is fair use. The document notes that the AP used his artwork and the artwork of others to create numerous photos which they then sell on their Web site. Double standard, anyone? • source
