Culture, Tech: Anonymous blogger cattiness isn’t protected, a judge says

  • A blog named Skanks in NYC wrote this mean, biting statement about model Liskula Cohen: “How old is this skank? 40 something? She’s a psychotic, lying, whoring, still going to clubs at her age, skank.” Cohen saw it and got mad. source
  • Cohen sued a few months ago, and on Monday, the court ruled that she was allowed to sue the anonymous blogger for defamation. And worse: Google has to reveal her identity. Yikes. This is bad precedent. source

Tech: That company that beat Microsoft in court: Really, we’re not bad

  • We’re not seeking to stop Microsoft’s business and we’re not seeking to interfere with all the users of Word out there.
  • I4i Chairman Loudon Owen • In an interview with CNet. Owen says his company, which has 30 employees and database products in use by big companies, hopes that the injunction against Microsoft Word gets his company’s technology removed – but doesn’t kill Word entirely. “The injunction is not saying there is no more Word for the world,” he said. “That is not our intention and that would not be a sensible remedy.” • source

U.S.: A drag racer wrecks, injuring his cousin. Who does the cousin sue?

  • Basically, under Massachusetts law I’m trying to get compensation for my client anywhere I can.
  • Roland Hughes • Lawyer for the father of Brandon Pereira, who was involved in an accident with his cousin Timothy. Timothy Pereira was drag-racing on the wrong side of the road at 81 mph in a 30 mph zone, and hit another car at high speed, injuring both passengers of that vehicle along with Brandon. Despite the fact that Timothy is in jail facing multiple charges for causing the accident, Hughes filed a lawsuit against the people in the other vehicle. Which is just disgusting. • source

Biz, Tech: Irony continues to ensue with Amazon’s “1984” Kindle removal

  • In an attempt to avoid a lawsuit over rights, Amazon decided to delete already-purchased copies of George Orwell’s most famous novels – “1984” and “Animal Farm.” source
  • People loudly complained, saying that it was unfair to consumers and that the deletions set a pretty sad-slash-hilarious example, considering the books’ context. source
  • A ticked-off high school student sued Amazon, saying that he had his notes on the book for school ruined because of Amazon’s, well, Orwellian way of handling things. source

Biz, U.S.: The fight over Shepard Fairey’s Obama “Hope” illo gets messy

  • Plaintiffs have profited from the sales of Mr. Garcia’s copyrighted photograph image and Defendant AP seeks to reap some of the profit by claiming that it – and not Mr. Garcia – is the rightful owner of the copyright in the photograph.
  • A legal memorandum in support of photographer Manuel Garcia • Regarding Fairey v. Associated Press, i.e. the legal battle over the iconic Obama “Hope” poster. For those not in the loop, Shepard Fairey did an immaculate illustration based on a photo Garcia shot and AP ran on the wire. After it blew up, AP sued Fairey, who claimed fair use. Now, Garcia’s claiming neither of them have the right to claim that photo as theirs. We agree that Garcia has a claim over this, but point out that if you look on Getty Images, Obama has literally hundreds of photos taken of him each week (and in April of 2006 alone, he showed up on Getty 41 times) – a fact which we think dilutes both his and AP’s claims. He’s a famous person who gets photographed a lot. Fairey just grabbed a random photo. • source

Sports: Dirk Nowitzki’s ex has a bun in the oven. He wants sole custody.

  • Our only focus in this case is to ensure the laws of the state of Texas are complied with to protect any and all rights Taylor has in delivery [of the baby] and her rights as a mother.
  • Scott Renick • Lawyer for Crystal Taylor, the ex-girlfriend of Dallas Mavericks superstar Dirk Nowitzki. Taylor is currently pregnant, and if that child proves to be his, Nowitzki wants it as his and his alone. That sounds like a very strange minefield to wade through, by the way, fraught with drama. • source

Culture: The author of the unsanctioned “Catcher in the Rye” sequel responds!

  • The backstory J.D. Salinger wrote this book called “Catcher in the Rye” that’s required reading for high schoolers and became a recluse. Then, he came out of hiding to file a lawsuit against some guy writing a new book about the book’s protagonist, 60 years later. source

U.S.: Match.com meets its match in the form of a lonely Brooklyn man

  • Match’s policy causes severe emotional distress and anxiety for some [subscribers], including those who keep writing e-mails to one member after another and never hear back because he/she is writing to people who’ve canceled.
  • A lawsuit filed by Sean McGinn • In response to Match.com’s sucky policy of charging money and deceptively making it seem like all these women are interested in you when really you’re a lame bastard eating Cheetos and talking to yourself on the Internet. Have you tried Craigslist, Sean? Oh wait. • source
